This “Privacy Policy” governs the processing of your personal data by the Antwerp-Bruges Port Authority, the data controller.

Please read this Privacy Policy carefully as it contains essential information about how your personal information is processed and what cookies are used. By providing your data on the Website https://portofantwerpbruges.ikmeld.be, and by using the email addresses provided on this Website, you declare that you have read this Privacy Policy and also expressly agree to it, as well as to the processing itself. 

General

The Antwerp-Bruges Port Authority will comply with all applicable data protection legislation, whether national, European, or international. 

It also takes into account the European Regulation 2016/679 of 27 April 2016 on the protection of personal data (General Data Protection Regulation; hereinafter “AVG”), as well as the adaptations of national laws to this European Regulation.

On the Website, there will be three sections: “Complaints”, “Questions” and “Anonymous hotline”. 

The Anonymous hotline is a collaboration between the Federal Police and the Antwerp-Bruges Port Authority. In this section, various reports can be made (anonymously) (e.g.: activities that are not in line with normal activities, unauthorized persons on board of a vehicle or vessel). 

The sections Complaints and Questions (“Complaints and Questions”) concern reports for complaints and questions related to the Antwerp-Bruges Port Authority and/or the functioning of the Antwerp-Bruges Port Authority. 

Anonymous hotline

All reports are automatically and immediately transmitted to the West Flanders Federal Police (“Competent Authorities”), without the intervention of any other party having access to these reports and the (personal) data contained therein.

Under no circumstances will the Antwerp-Bruges Port Authority have access to the reports. If required and indicated so, the Competent Authorities may contact you through the contact details you have provided (email or telephone number).

Given the guarantee of anonymity, enormous importance is attached to the protection of your data. All parties involved comply with the applicable laws and regulations at all times. All anonymous reports are transmitted directly and automatically to the Competent Authorities. The Antwerp-Bruges Port Authority or any other organization has no control over the content of the reports, nor over the associated data, such as any personal data.

Personal data and purposes of processing

The concept of personal data is interpreted according to the definition by the AVG, being “any information relating to an identified or identifiable natural person (“data subject”); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.” (“Personal Data”).

The Antwerp-Bruges Port Authority acts as the controller of the processing of your Personal Data, obtained through the website (via cookies, contact forms, etc.) or via the e-mail addresses made available on the website.

The Antwerp-Bruges Port Authority will use your Personal Data collected exclusively for the following purposes:

  • Handling the question or complaint and providing feedback with the necessary information;
  • Contacting the Competent Authorities, if requested;
  • Maintaining and improving the website and including personal data in anonymous statistics, with as legal basis the legitimate interests of the Antwerp-Bruges Port Authority to continuously improve its website and services;
  • Cookies for the improvement of the Antwerp-Bruges Port Authority’s website and services.

You are not required to disclose your Personal Data, but understand that the provision of certain services will become impossible if you refuse the processing.

Transfer of Personal Data

All information, data and any Personal Data, will only be transferred directly to the Competent Authorities. No information, data and/or Personal Data, will be available to any other party at any time. The only party that will receive data is the Competent Authorities.

The Antwerp-Bruges Port Authority will not sell, rent, distribute or otherwise make your Personal Data commercially available to third parties, except within the framework of a restructuring (subject to notification, unless this is technically or commercially infeasible), or unless with your prior consent.

In rare instances, the Antwerp-Bruges Port Authority may need to disclose your Personal Data pursuant to a court order or to comply with other mandatory laws or regulations. The Antwerp-Bruges Port Authority will use reasonable efforts to provide you with prior notice, unless restricted by law.

Anonymous hotline section

If someone makes an anonymous report through the Website (“Reporter”), no Personal Data will be requested or required. If the Reporter wishes to be contacted by the Competent Authorities, he or she can provide contact information through the Website. It is up to the Reporter to choose which contact details to communicate; these may be an email address and/or a telephone number. The details will then be transmitted directly to the Competent Authorities.

The Reporter may, however, choose to share other (Personal) Data in the description of the situation (as part of the report), but this is not obligatory or required.

The data collected will only be used for the purposes for which the information was obtained from the Reporter. If the Reporter indicates in the anonymous report that he or she wishes to be contacted, the Personal Data will be used to contact the person.

Completely anonymous data (no Personal Data) will be used for statistical purposes (e.g. reporting the number of reports).

Security of Personal Data

The Antwerp-Bruges Port Authority has taken both organizational and technical security measures to avoid the destruction, loss, falsification, (unauthorized) modification, unauthorized access or notification to third parties, as well as to avoid any other unauthorized processing of data. In respect of your privacy and in the interest of your online security, this Website is an HTTPS site. This means that all communication is encrypted (e.g. when you enter personal data in the form, HTTPS protects this data so that no one can ‘look in’).

Duration of processing

Personal data will be retained and processed by us for a period of time necessary in relation to the purposes of processing and in relation to the contractual relationship between the Antwerp-Bruges Port Authority and you.

Anonymous hotline section

The report and/or any Personal Data of the Reporting Party are automatically transmitted to the Competent Authorities. These authorities will retain the collected and processed (Personal) Data up to the legal retention period.

Your rights

You have the following rights, in relation to your personal data:

  • Right of access and inspection: you have the right to become aware of your personal data at any time, free of charge, as well as of the use that the Antwerp-Bruges Port Authority makes of your personal data.
  • Right to rectification, deletion and restriction: you have the right to request us to rectify, supplement or delete your personal data. You acknowledge that if you refuse to communicate or request the removal of personal data, certain services and products will not be available. You may also request that the processing of your personal data be restricted.
  • Right to object: you have the right to object to the processing of your personal data for serious and legitimate reasons. In addition, you always have the right to oppose the use of personal data for direct marketing purposes; in such case, you do not have to provide reasons.
  • Right of free data transfer: you have the right to obtain and/or transfer to other responsible parties your personal data processed by us in a structured, common and machine-readable form.
  • Right to withdraw consent: insofar as the processing is based on your prior consent, you have the right to withdraw such consent.

This is without prejudice to a remedy before a civil court. 

2 Anonymous hotline section

In general, you are entitled to various actions from the organization that collects and processes your data. In the context of reports through this section, the Personal Data are immediately transferred to the Competent Authorities and no data or information are retained or received by other parties or organizations.

As a result, although you have your rights, in practice they cannot be exercised by the Antwerp-Bruges Port Authority or any other organization, as they do not have access to your (Personal) Data.

The only party with whom the Reporter can exercise his or her rights is the Competent Authority. A request to exercise your rights with the competent bodies should be addressed to the competent supervisory authority, namely:
